DWI, DUI, or CVO

Driving While Impaired (DWI) and Driving Under the Influence (DUI) essentially stand for the same thing and are used interchangeably. The most common reason a person is charged with DWI is that the person is believed to be under the influence of alcohol. The next most common reason would be because they are under the influence of a controlled substance. Criminal vehicular operation (CVO) typically involves either of these situations and bodily harm to another.

DWIs are enhanceable offenses, which means a conviction for a DWI can lead to more serious penalties if charged with another DWI in the future. The best defense to DWI/DUI involves reviewing the police reports and squad video to determine the stop of your vehicle and whether or not the police violated your rights.

Next, we look to the testing method used in your case and determine the reliability of the test. In Minnesota, the BCA uses the Data Master Machine (DMT) to administer breath tests. These devices have been proven to be particularly unreliable with tests near important legal limits. We have experience presenting the scientific evidence involved with the DMT machines to Judges and Juries.
